In accordance with the Development Corporation Act, Section 505.159 of the Texas Local Government Code, a public hearing will be held by the Southmayd Community Development Corporation, a Type B corporation, on Tuesday, March 14, 2017, at 6:30 p.m. at Southmayd City Hall, located at 4525 Elementary Drive, Southmayd, Texas, to consider and take action upon the following project: Water Tower Project. It is requested that you make your views known, either in person or by writing to the Southmayd Community Development Corporation. The mailing address is PO Box 88, Southmayd, TX 76268.

ORDINANCE NO. 401
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SOUTHMAYD, TEXAS, DECLARING AS ELECTED THE UNOPPOSED CANDIDATES FOR MAYOR AND TWO COUNCIL MEMBERS, AT-LARGE, EACH TO TWO-YEAR TERMS OF OFFICE; FINDING THAT ALL NECESSARY AND REQUIRED LEGAL CONDITIONS HAVE BEEN SATISFIED; PROVIDING THAT THE GENERAL ELECTION TO BE HELD ON MAY 6, 2017, SHALL BE CANCELLED; PROVIDING FOR POSTING OF THIS ORDINANCE ON ELECTION DAY, MAY 6, 2017; PROVIDING FOR A SEVERABILITY CLAUSE AND A SAVINGS CLAUSE; REPEALING ALL CONFLICTING ORDINANCES; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Southmayd, Texas (“City Council”), adopted Ordinance No. 399 on January 10, 2017, ordering a general election to be held on May 6, 2017, for the purpose of electing a Mayor and two Council Members, at-large, each to two-years terms; and
WHEREAS, pursuant to Sections 143.007 and 146.054 of the Texas Election Code, the deadlines for filing applications for a place on the ballot and for the declaration of write-in candidacy for the City’s general election scheduled for May 6, 2017, have expired; and
WHEREAS, the City Secretary, in accordance with Section 2.052 of the Texas Election Code, has certified in writing to the City Council that Tom Byler is unopposed for election as Mayor; and
WHEREAS, the City Secretary, in accordance with Section 2.052 of the Texas Election Code, has certified in writing to the City Council that Michael Horstman and David Turner are unopposed for election as Council Members; and
WHEREAS, the City Council, upon receipt and review of such written certification, finds and determines that the candidates whose names are to appear on the ballot in said general election for Mayor and Council Members, at-large, are unopposed, and that there are no declared write-in candidates and no propositions to appear on the ballot for said general election.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHMAYD, TEXAS, THAT:
Section 1. FINDINGS INCORPORATED
The recitals set forth above are found to be true and correct and are incorporated into the body of this Ordinance for all purposes.
Section 2. UNOPPOSED CANDIDATES DECLARED ELECTED
In accordance with Section 2.053(a) and (e) of the Texas Election Code, the following unopposed candidate is declared duly elected as City Council Members and shall be issued a certificate of election following the date on which the general election for City Council would have been canvassed:

Section 3. GENERAL ELECTION CANCELLED
In accordance with Section 2.053(b) of the Texas Election Code, the general election called and ordered for May 6, 2017, shall not be held and is cancelled.
Section 4. POSTING REQUIREMENT
In accordance with Section 2.053(a) of the Texas Election Code, the City Secretary is directed to cause a copy of this Ordinance to be posted on Election Day, being May 6, 2017, at all polling places that would have been used in such election.
Section 5. REPEALER CLAUSE
This Ordinance shall be and is declared to be cumulative of all other ordinances of the City of Southmayd, Texas and this Ordinance shall not operate to repeal or affect any of such other ordinances except insofar as the provisions thereof might be inconsistent or in conflict with the provisions of this Ordinance, in which event such conflicting provisions, if any, in such other ordinance or ordinances are repealed.
Section 6. SAVINGS CLAUSE
The City of Southmayd Code of Ordinances remains in full force and effect, except as amended by this Ordinance.
Section 7. SEVERABILITY CLAUSE
It is the intent of the City Council that each paragraph, sentence, subdivision, clause, phrase, or section of this Ordinance be deemed severable, and should such paragraph, sentence, subdivision, clause, phrase, or section be declared invalid or unconstitutional for any reason, such declaration of invalidity or unconstitutionality shall not be construed to affect the validity of those provisions of this Ordinance left standing, or the validity of any other ordinances of the City of Southmayd.
Section 8. EFFECTIVE DATE
This Ordinance shall take effect and shall be in full force from and after its adoption and publication as provided by law.
PASSED, APPROVED AND ADOPTED by the City Council of the City of Southmayd, Texas, on this 14th day of March, 2017.
